Welcome to TerraCostaRica.com, a website owned by iQu Servicios Comerciales, which acts as a digital platform for publishing, promoting, and managing real estate listings in Costa Rica. By accessing or using this site, you agree to comply with these Terms and Conditions of use. If you do not agree with any part, please refrain from using the site.

1. Acceptance of Terms

Access to and use of the TerraCostaRica.com website (hereinafter “the Site”) implies full and unconditional acceptance of all the terms and conditions set forth herein. These terms may be modified at any time without prior notice, and it will be the user’s responsibility to review them periodically.

2. Definitions

• The Site: TerraCostaRica.com and all its subdomains.
• The User: Individual or legal entity who accesses, browses, consults, publishes, or interacts with the Site.
• Advertiser or Agent: Registered user who publishes properties or real estate services.
• Client or Visitor: User interested in properties, without publishing listings.
• Content: All information published on the site by users or the platform.

3. Registration and User Account

3.1. Requirements

To publish listings or access advanced features, the User must register, providing truthful, updated, and complete information. TerraCostaRica.com reserves the right to verify such information and suspend accounts with fraudulent or inaccurate data.

3.2. Account Security

The User is responsible for:

• Maintaining the confidentiality of their credentials.
• All activity carried out under their account.
• Updating their data in case of changes.

3.3. Informed consent for personal data processing

Before completing registration, the User must read and expressly accept these Terms and Conditions and the Privacy Policy through an unchecked checkbox or another equivalent electronic mechanism that creates a record of the User’s decision.

By granting consent, the User freely, previously, expressly, and knowingly authorizes iQu Servicios Comerciales SRL, the entity responsible for TerraCostaRica.com, to collect, store, and process the personal data provided, including name, email address, telephone number, and other information necessary to create and manage the account, provide requested services, publish and manage listings or profiles, facilitate contact with interested persons, process payments and invoicing when applicable, send operational communications, prevent fraud or abuse, and comply with legal and contractual obligations.

Contact information selected by the User for publication may be displayed to visitors or communicated to interested third parties according to the Site functions used by the User. Internal account information will not be published automatically unless the User has expressly selected it as public or contact information.

Providing information identified as mandatory is necessary to create an account or provide certain services. Refusal to provide it, or its later deletion when it remains essential, may prevent registration, publication, or continuation of the corresponding service.

The User may exercise the rights of access, rectification, cancellation, and objection, and may revoke consent without retroactive effect, by writing to privacidad@terracostarica.com. TerraCostaRica.com may retain electronic evidence of acceptance, including the date, time, IP address, language, and version of the documents accepted.

4. Use of the Site

The company undertakes to provide a platform for the user to publish real estate listings for sale or rent.

4.1. Permitted Use

The User agrees to use the Site only for legitimate purposes, in accordance with Costa Rican law and these Terms. The following is prohibited:

• Publishing false, misleading, or fraudulent content.
• Using contact data for spam, scams, or unauthorized commercial activities.
• Using automated tools to collect information from the site without authorization.
• Publishing photos or videos containing images of minors.
• Copying, distributing, or reusing content without authorization.

4.2. User Content

All content published by the User (texts, images, videos, etc.) must be their property or they must hold the necessary rights for its use. The User grants TerraCostaRica.com a non-exclusive, worldwide, royalty-free license to display and distribute such content within the site.

5. Listings and Publications

5.1. Rules for Publications

• Contain truthful information about the property for Sale or Rent.
• Include real and updated photos. Computer-generated images are allowed as long as they represent the reality of the project being sold or rented.
• Be properly classified according to their type (sale, rent), in the correct category (residential, land, commercial), and correctly assigned according to the features offered.
• Listings that allow geolocation by GPS latitude and longitude must have a geographic location within a maximum range of 2 kilometers from the real point. For security reasons, users are advised not to use the exact location for residential properties.
• Listings that allow linking video from YouTube, Vimeo, or Dailymotion must comply with: The video must be related to the property for Sale or Rent, must not contain images of minors, and must not contain pornographic content or nudity of any kind.

TerraCostaRica.com reserves the right to edit, suspend, or remove any publication that does not comply with these rules or that negatively affects the experience of other users.

5.2. Review of Listings

Listings may be subject to review by the administrative team before publication. Review time may vary, but generally will be a maximum of 24 hours on business days, Monday to Friday, from 8am to 5pm. Listings published outside business hours will be reviewed the next regular working day.

6. Plans, Memberships, and Payments

6.1. Types of Services

TerraCostaRica.com offers free and paid services, which include but are not limited to:

• Free Listings.
• Premium Listings.
• Featured Listings.
• Memberships with listing packages.
• Sale of property signs.

6.2. Payment Policies

Payments are made through secure providers (for example, TiloPay). By confirming a transaction, the User accepts the indicated charges and understands that there are no refunds unless otherwise expressly stated.

6.3. Billing

Users who request it may opt to receive an electronic invoice, provided they supply the corresponding tax information before making the payment. If the client does not have registered tax information, or if requested, the company will issue an anonymous electronic ticket in compliance with the relevant legislation for reporting its sales.

The company will provide means for the user to view charges made to their account. The information will be displayed on the company’s website, on the payment platform’s website, or both.

7. Responsibility and Warranties

7.1. Disclaimer

TerraCostaRica.com acts only as an intermediary for contact between interested parties. It is not a party to nor does it guarantee any real estate transaction, nor does it thoroughly verify the legality or conditions of the properties listed.

It is strongly recommended that parties consult with a notary and attorney before making any real estate transaction.

7.2. Service Availability

The Site is provided “as is” and “as available.” We do not guarantee it will be error-free, virus-free, or uninterrupted. We reserve the right to suspend it temporarily or permanently without prior notice.

8. Intellectual Property

All proprietary content of the Site (logos, trademarks, design, source code, databases, etc.) is owned by TerraCostaRica.com or its licensors and is protected by intellectual property laws. Reproduction in whole or in part without prior written authorization is prohibited.

9. Privacy and Data Protection

9.1. Data Processing

The data provided by the User will be processed in accordance with the Site’s Privacy Policy, which is an integral part of these Terms. We use cookies to improve the user experience.

9.2. Responsibility for Published Information

The User is solely responsible for the data they publish, as well as its use, and guarantees that it does not violate third-party rights.

10. Third-Party Links

The Site may contain links to other websites. TerraCostaRica.com is not responsible for the contents, practices, or privacy policies of such external sites.

11. Account Termination

TerraCostaRica.com reserves the right to suspend or cancel a user account without prior notice if misuse, fraud, spam, or violation of these Terms is detected.

12. Applicable Law and Jurisdiction

Applicable Law

These Terms are governed by the laws of the Republic of Costa Rica, including, among others, Law No. 8968: Law on the Protection of the Person regarding the Processing of their Personal Data.

By using this site, you agree that any dispute arising from its use will be resolved in accordance with said legislation and before the competent courts of the country.

Responsibility for Third-Party Data

Use of Third-Party Data

If a User includes personal data of third parties (for example, when publishing a property on behalf of a relative or represented person), they guarantee that they have the prior, informed, and express consent of the data subject.

TerraCostaRica.com is not responsible for claims arising from the unauthorized use of third-party personal information.

The User may consult the Privacy Policy to learn about their rights regarding the protection of personal data, as well as the procedure to exercise them under Law No. 8968. Such policy is available on the website and forms an integral part of these Terms and Conditions.

The use of this site is subject to our Privacy Policy, which describes how we handle users’ personal information, including residents of the European Union (under the General Data Protection Regulation – GDPR) and the United States (under laws such as California’s CCPA).

Users may declare in their professional profiles any credentials, memberships, certifications, or professional designations they hold.

By submitting this information, the user represents that they possess the stated credentials and that all information provided is accurate, complete, and up to date. The user assumes full responsibility for the accuracy and legality of the information published.

TerraCostaRica.com does not verify, certify, or guarantee the authenticity, validity, or current status of any credentials published by users. Such information is displayed solely for informational purposes and reflects declarations made by each individual agent or agency.

TerraCostaRica.com reserves the right to hide or remove any credential, membership, certification, or professional designation if it receives a complaint, detects potential misuse, false information, or any violation of these Terms and Conditions, without incurring any liability.

The publication of a credential, membership, certification, or professional designation does not imply that TerraCostaRica.com has any commercial relationship, institutional affiliation, endorsement, certification, or sponsorship with the issuing organization, nor does it imply any endorsement by the issuing organization of TerraCostaRica.com.

18. Real Estate Business Directory

18.1. Nature of the service

The Real Estate Business Directory allows businesses, professionals, and service providers related to real estate to create and publish a profile to present their services. TerraCostaRica.com acts solely as a publishing, search, and contact platform; it does not represent, certify, recommend, or guarantee listed providers, nor does it participate in the negotiation, engagement, payment, performance, or outcome of their services.

Before hiring a provider, the User must independently verify the provider’s identity, experience, permits, licenses, professional registrations, prices, terms, and references.

18.2. Profile information, review, and publication

The account holder is responsible for ensuring that the business information is truthful, current, lawful, and sufficient, including the business name, services, service area, contact details, descriptions, images, credentials, website, and social media profiles.

Profiles are subject to review. Approval does not constitute an endorsement, certification, or guarantee by TerraCostaRica.com. The platform may request clarification, return a profile to draft status, suspend it, or remove it when it violates these Terms. Material changes made after approval may require a new review without changing trial, billing, renewal, or financial-service dates.

18.3. Services, service areas, and featured placements

Each business may identify a primary service, related services, and the areas where it provides service. Featured placements may be subject to limited availability by service and canton. TerraCostaRica.com may reorganize categories, services, labels, and locations to maintain the quality and structure of the Directory.

18.4. Subscription, free period, and renewal

Enrollment may include a free period according to the plan in effect when the subscription is created. When a payment method is registered, the payment provider may perform a temporary card verification or tokenization. After the free period ends, the subscription will be charged automatically according to the price, billing frequency, and conditions disclosed before confirmation.

Discounts, coupons, or promotions, when available, are subject to their specific terms and will not change subsequent renewals unless expressly stated. In the event of a declined payment, expiration, cancellation, or breach, TerraCostaRica.com may suspend profile visibility and, for featured plans, suspend or release the corresponding placement. Canceling automatic renewal may allow the service to remain active until the end of the period already paid.

18.5. Contacts, statistics, and results

Visitors may contact the business by telephone, WhatsApp, email, contact form, or other published methods. The business agrees to receive inquiries related to its services. TerraCostaRica.com may send the visitor a copy of the inquiry and retain technical evidence of delivery for security, statistics, and incident support.

The platform may record and display metrics such as impressions, profile views, messages sent, and clicks on telephone, WhatsApp, website, or social media links. These statistics are informational, may contain technical differences, and do not guarantee any minimum number of visits, contacts, clients, sales, or engagements.

18.6. Business responsibility

Each business is solely responsible for its services, communications, offers, charges, legal obligations, and relationships with its clients. TerraCostaRica.com is not liable for damages, losses, breaches, fraud, accidents, professional errors, disputes, or outcomes arising from the relationship between visitors and businesses.
